Justice of the Peace (JP)

A Justice of the Peace (JP) in South Australia is typically someone of good stature in the community who, providing they are satisfied with the capability of the signatory, are able to witness and sign documents.

  • This is a walk-in service; no appointments are necessary.
  • Please arrive early and at least 15 minutes before the end of the session. Our JP may not be able to stay past their finishing time to assist you, so we cannot guarantee you will be seen.
  • Make sure you bring appropriate ID, such as a driver's licence, proof of age card, passport etc, as some documents may require the JP to confirm your identity.
  • Bring the original documents with you in order to have copies certified. You must organise your copies prior to attending the Administration Centre.
  • If you have complex or multiple documents that require more than 5 minutes to witness, such as an Advance Care Directive, your service may be interrupted, and you will be asked to re-join the queue while others receive assistance.

FAQS

What services can a JP provide?

A Justice of Peace are authorised is authorised to witness and sign:

  • Statutory declarations
  • Affidavits
  • Waiver rights
  • Search warrants
  • Divorce documents

A JP can also certify copies of original documents as well as witness the signing of advanced care directive documents. Please note if any birth/death/marriage certificates or licences need certification, copies of both front and back are required.

Can a JP sign a Will?

A Justice of the Peace is not required to sign a will.
To properly witness a will, 2 individuals over the age of 18 must be present at the same time and sign using the same pen. Both witnesses must not be named in the will.

Can a JP certify electronic documents?

JPs can only certify a copy of an electronic document if they are satisfied that the copy is a true and correct copy of the original document. To do this, the JP will need to:

  • See the copy being printed directly from the official website or computer that is under the control of the document's issuing authority;
  • See the electronic original on the official website that is under the control of the document's issuing authority and have compared the printed copy against the electronic original, or;
  • The issuing authority has endorsed the printed copy of the original document with an official stamp in ink.
How many documents can I get witnessed?

No more than 20 certified copies can be signed per person.

Who else can witness a Statutory Declaration?

Please organise your photocopying requirements prior to attending the Administration Centre.
