Temporary placement of containers on public roads

Application process

To obtain approval for placing a container on a public road, applicants must apply to council:

  1. Complete an application formMini-skip and Shipping Container Application
  2. Provide supporting documentation – Including a Certificate of Currency for $20 million Public Liability Insurance.
  3. Pay applicable fees – As determined by the Council in the Fees and Charges *Please note application fee is non-refundable
  4. Await Council approval – Approval must be granted before placing the container on the road.

Processing time: Applications are assessed within 10 business days, but more complex cases may take longer.

Permit duration

  • Standard approval is granted for up to 7 days.
  • Extensions may be requested, subject to additional fees and approval.

Placement guidelines and conditions

Positioning requirements

To ensure safety and minimal disruption, containers must be placed:

  • Parallel to the kerb and as close as possible to the edge of the road.
  • At least 10 metres from intersections and 2 metres from property driveways.
  • Ensuring a minimum clearance of 1.8 metres for pedestrian footpaths.
  • Outside restricted or high-speed zones (80km/h or above).
  • Away from essential infrastructure, such as fire hydrants, utility infrastructure, traffic lights, and bus stops etc.

Safety measures

Depending on location and visibility, the following safety requirements may apply:

  • Reflective tape or markings for visibility at night.
  • Traffic cones or barriers if located in a high-traffic area.
  • Flashing lights for placements in dimly lit areas or near intersections.

Responsibilities of the Permit Holder

  • Those granted approval for container placement must:
  • Follow all permit conditions and legal requirements.
  • Maintain the container in good condition, ensuring it does not pose a safety hazard.
  • Prevent damage to roads, footpaths, and public property.
  • Ensure proper waste disposal (for skip bins) in compliance with environmental regulations.
  • Provide proof of Public Liability Insurance if requested by Council officers.
  • Failure to comply with permit conditions may result in warnings, fines, cancellation of approval, or removal of the container at the owner's expense.

Council enforcement and compliance

The City of Marion’s Community Safety Inspectors actively monitor compliance with permit conditions. Enforcement measures include:

  • Unauthorised containers: Containers placed without approval may be removed by the Council.
  • Breach of conditions: Repeated violations may lead to permit cancellation and additional penalties.
